1. Acceptance of Terms

By downloading, installing, or using Oxi+ Player (the "App"), you ("User," "you") enter into a legally binding agreement with IoxTech GmbH ("we," "us," "Developer") and agree to these Terms of Service ("Terms").

If you do not agree to these Terms, do not install or use the App.

These Terms incorporate by reference:

2. Description of the App

Oxi+ Player is a media player application for Android TV, Apple TV, and mobile devices. It enables users to connect to media services, M3U playlists, and Xtream Codes API endpoints that they independently obtain and configure.

The App does not provide any media content, television channels, video-on-demand libraries, or any media content. See the Content Disclaimer for full details.

3. Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher) to use the App. By using the App, you represent that you meet this requirement.

4. License

Subject to your compliance with these Terms and the EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for your personal, non-commercial use.

This license does not include the right to:

  • Redistribute, sublicense, or resell the App
  • Modify, reverse engineer, or create derivative works
  • Use the App for any unlawful purpose

5. Activation and Trial

5.1 Activation Requirement

Full access to all App features requires a valid activation. You may obtain an activation code through authorized channels. Activation is linked to your device's unique identifier.

5.2 Trial Period

We may offer a free trial period ("Trial") allowing full access to the App for a limited number of days, as stated in the App at the time of commencement. The Trial:

  • Begins when you first accept the Trial offer in the App
  • Expires automatically at the end of the stated period
  • Cannot be restarted once it has expired on a given device
  • May be subject to limitations at our discretion
  • Does not create an obligation on our part to offer a Trial to any user

5.3 Demo Mode

The App may offer a limited "Demo Mode" allowing use with user-provided M3U sources without a paid activation. Demo Mode may impose restrictions including a limit on the number of playlists that can be added. Demo Mode does not provide all premium features.

5.4 No Refund Policy

Activation codes are generally non-refundable once redeemed. If you purchased an activation code through an authorized reseller, refund policies of that reseller may apply.

5.5 Activation Transfer

Activations are tied to specific devices and may not be transferred to different devices without our prior written approval. Contact support@oxi.plus for device transfer requests.

6. User Obligations

You agree to:

  1. Use the App lawfully. You will not use the App to access, stream, or distribute any content that you do not have the legal right to access.

  2. Maintain your own media subscriptions. Any media service, playlist, or Xtream Codes account you connect to the App must be a service to which you hold a valid and lawful subscription.

  3. Not use the App to infringe intellectual property. You will not use the App to access pirated content, unauthorized streams, or content obtained in violation of copyright law.

  4. Protect your credentials. You are responsible for keeping your server credentials secure. We accept no responsibility for unauthorized access resulting from your failure to protect your credentials.

  5. Not circumvent technical measures. You will not attempt to bypass, disable, or circumvent the activation or licensing system.

  6. Not share activations. You will not share your activation code or activated App with persons not authorized under your license.

7. Prohibited Uses

You may not use the App to:

  • Stream or access content for which you lack a lawful license or subscription
  • Redistribute, publicly display, or re-broadcast content received through the App
  • Violate any applicable law, regulation, or third-party rights
  • Introduce malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our activation servers or any third-party system
  • Impersonate any person or entity
  • Engage in any activity that could damage, disable, or impair our services

8. Third-Party Services and Content

8.1 Third-Party Media Sources

The App allows you to connect to third-party media services and content sources. We are not responsible for:

  • The availability, quality, or legality of third-party content
  • Any interruption, failure, or discontinuation of third-party services
  • Any content viewed through third-party sources configured in the App

8.2 Third-Party APIs

The App may use third-party APIs for weather, sports data, and content metadata. These services have their own terms of service and privacy policies which apply to data exchanged with them.

9. Intellectual Property

All intellectual property rights in the App, including its software code, design, interface, and trademarks, are owned by IoxTech GmbH or its licensors. Nothing in these Terms transfers any ownership of intellectual property to you.

"Oxi+ Player" and any associated logos are trademarks of IoxTech GmbH. You may not use them without our prior written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your specific requirements
  • The App will operate uninterrupted, error-free, or without delay
  • Any errors in the App will be corrected
  • The App will be compatible with all devices or operating system versions
  • Any third-party media service connected through the App will function correctly

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IoxTech GmbH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Any content accessed through third-party media sources configured in the App
  • Any interruption, suspension, or termination of the App or activation service
  • Any other matter relating to the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR YOUR ACTIVATION LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow exclusion of certain warranties or limitation of certain liabilities. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless IoxTech GmbH, its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the App in violation of these Terms
  • Your access to unauthorized content through the App
  • Your violation of any applicable law or third-party rights
  • Any content you stream or access through the App

13. Termination

We reserve the right to:

  • Suspend or terminate your activation if you violate these Terms
  • Discontinue the App or activation service at any time with reasonable notice
  • Modify or discontinue any feature of the App without liability

Upon termination, your license to use the App ceases and you must uninstall the App from all devices.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved by binding arbitration administered by German Arbitration Institute (DIS) in [CITY, COUNTRY], except that either party may seek injunctive relief in any court of competent jurisdiction.

For EU consumers: Nothing in these Terms affects your rights under applicable consumer protection laws in your EU member state. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

For Turkish users: Disputes may be submitted to the consumer arbitration committees (Tüketici Hakem Heyeti) as provided by Turkish consumer law.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes through the App. Your continued use after the effective date of updated Terms constitutes acceptance.

16. Severability

If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, EULA, and Content Disclaimer, constitute the entire agreement between you and IoxTech GmbH regarding the App and supersede all prior agreements.
