End-User License Agreement (EULA)

IMPORTANT: READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THE APP. BY INSTALLING, ACTIVATING, OR USING Oxi+ Player, YOU AGREE TO BE BOUND BY THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE APP.

1. Parties

This End-User License Agreement ("EULA") is a legal agreement between:

  • Licensor: IoxTech GmbH, the developer and owner of Oxi+ Player ("we," "us")
  • Licensee: You, the end user ("you," "User")

2. Grant of License

Subject to your full compliance with this EULA and timely payment of any applicable license fee, we grant you a:

  • Limited — only for the purposes expressly stated herein
  • Non-exclusive — we may grant the same rights to others
  • Non-transferable — you may not assign or transfer this license
  • Revocable — we may terminate this license for breach
  • Personal — for your individual use only

3. Scope of License — What You May Do

Under this EULA, you may:

  • Install the App on the permitted number of devices you own or control
  • Use the App to connect to media sources, M3U playlists, and Xtream Codes API endpoints that you have lawfully obtained
  • Create a reasonable number of playlist source configurations for your personal use
  • Make one (1) backup copy of the App solely for archival purposes

4. Restrictions — What You May NOT Do

You may not:

  1. Copy or reproduce the App beyond what is expressly permitted
  2. Modify, adapt, translate, or create derivative works based on the App
  3. Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the App
  4. Remove or alter any proprietary notices, labels, or marks in the App
  5. Sublicense, sell, rent, lease, lend, or otherwise transfer the App or your license rights to any third party
  6. Share your activation with other users or devices beyond those covered by your license
  7. Use the App commercially — including providing access to the App as part of a service, product, or paid offering — without our express written consent
  8. Circumvent, disable, or interfere with any digital rights management (DRM), activation, or license enforcement mechanism
  9. Use the App to access, distribute, or facilitate access to unlicensed, pirated, or otherwise infringing content
  10. Distribute the App through any channel other than authorized app stores or directly from us

5. Activation System

5.1 Device Binding

Activations are bound to a specific device. When you activate the App, a device identifier is registered with our licensing server. This binding is necessary to enforce the license.

5.2 Deactivation and Transfer

To transfer your activation to a new device:

  • Contact us at support@oxi.plus
  • A reasonable number of device transfers per license period may be permitted at our discretion
  • We reserve the right to limit or deny transfers where we suspect abuse

5.3 Activation Code Validity

Activation codes:

  • Are valid for a single use unless otherwise specified
  • Expire as stated at the time of issuance
  • Cannot be replaced if lost, stolen, or shared without authorization

6. Trial License

If you are using the App under a Trial:

  • The Trial grants full access to App features for the stated Trial period
  • The Trial begins on the date you first accept the Trial offer
  • Upon expiration, access to premium features will be restricted unless you obtain a paid activation
  • One Trial is permitted per device; the Trial cannot be repeated on the same device
  • The Trial license terminates automatically at the end of the Trial period without notice
  • We reserve the right to modify, limit, or discontinue Trial offers at any time

7. Demo Mode License

If you use the App in Demo Mode (without activation):

  • You may connect a limited number of M3U sources (currently: 1 source)
  • Certain premium features are not available in Demo Mode
  • Demo Mode is provided without charge and without warranty
  • We reserve the right to change or discontinue Demo Mode at any time

8. Ownership and Intellectual Property

The App, including all copies, is proprietary to IoxTech GmbH and title to the App shall remain with us. This EULA does not constitute a sale and does not transfer to you any title or ownership of the App or any intellectual property rights.

The App is protected by:

  • Copyright laws and international treaty provisions
  • Other intellectual property laws and treaties

9. Updates and Upgrades

We may, at our discretion and without obligation, provide:

  • Bug fix updates to the App
  • Feature updates or new versions of the App

Updates, if any, may be provided at no additional charge or for a fee, as determined at our discretion. We are not obligated to provide any updates, patches, or support for any version of the App.

10. Open Source Components

The App may include open source software components. Such components are licensed under their respective open source licenses (e.g., MIT, Apache 2.0). A list of open source components used in the App is available at https://oxi.plus/open-source or within the App. This EULA does not limit any rights granted under those open source licenses.

11. Disclaimer of Warranties

THE APP IS LICENSED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • TITLE AND NON-INFRINGEMENT
  • THAT THE APP WILL OPERATE WITHOUT INTERRUPTION OR ERROR
  • THAT THE APP WILL BE COMPATIBLE WITH ANY SPECIFIC THIRD-PARTY MEDIA SERVICE

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability to you for any claim arising under this EULA shall not exceed the license fee you paid for the applicable license period

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

13. Content — No Liability

We have no responsibility for any content accessed, streamed, or downloaded through the App. You assume full responsibility and liability for your use of the App to access any content. We expressly disclaim any liability for:

  • Copyright infringement or other intellectual property violations arising from your use of the App with unauthorized content
  • Any claims by third-party rights holders arising from your access to their content
  • Any legal proceedings or sanctions resulting from your use of unlicensed media content

14. Termination

14.1 Termination by You

You may terminate this EULA at any time by uninstalling the App from all devices. Termination does not entitle you to a refund of any license fee paid.

14.2 Termination by Us

We may terminate this EULA immediately and without notice if you:

  • Breach any material term of this EULA
  • Are found to be using the App to access unlicensed content
  • Circumvent or attempt to circumvent the activation or license system
  • Engage in any activity that, in our reasonable judgment, harms our business or other users

14.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ceases
  • You must uninstall the App from all devices
  • Any data stored locally by the App may be deleted
  • Sections 8, 11, 12, 13, and 16 shall survive termination

15. Export Compliance

You agree to comply with all applicable export laws and regulations. You represent that you are not located in, or a national of, any country that is subject to applicable trade restrictions.

16. Governing Law

This EULA shall be governed by the laws of Germany. Any disputes shall be resolved in accordance with the dispute resolution provisions in the Terms of Service.

17. Entire Agreement

This EULA, together with the Terms of Service, Privacy Policy, and Content Disclaimer, constitutes the entire agreement between you and us concerning the App and supersedes all prior agreements and understandings.
